1. Agreement to Terms

By accessing or using ShutterLove ("the Service"), operated by ShutterLove ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Description of Service

ShutterLove provides a digital service that transforms static photographs into animated video keepsakes. Our service includes:

• Photo upload and processing
• AI-powered photo animation
• Digital delivery of animated videos
• Optional add-ons such as background music and video compilation

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. User Accounts

You may use our Service without creating an account. However, if you choose to create an account, you are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

5. User Content and Rights

5.1 Your Content

You retain all ownership rights to the photos you upload ("User Content"). By uploading photos, you grant us a limited, non-exclusive license to process, animate, and deliver your content solely for the purpose of providing the Service.

5.2 Content Restrictions

You agree not to upload content that:

• You do not own or have the right to use
• Infringes on any third party's intellectual property rights
• Contains illegal, harmful, or offensive material
• Violates any applicable laws or regulations
• Contains malware or harmful code

5.3 Content Deletion

We automatically delete uploaded photos from our servers within 30 days of order completion. You may request earlier deletion by contacting us at support@shutterlove.ai.

6. Orders and Payment

6.1 Pricing

All prices are displayed in US Dollars and are subject to change without notice. The price at the time of purchase will be honored for that order.

6.2 Payment

We accept major credit cards and other payment methods as displayed at checkout. Payment is processed securely through our third-party payment processor (Stripe). We do not store your complete credit card information.

6.3 Delivery

Standard delivery is within 48 hours of order confirmation. Rush delivery (24 hours) is available for an additional fee. Digital products are delivered via email and/or download link.

7. Refunds and Satisfaction Guarantee

We offer a 100% satisfaction guarantee. If you are not completely satisfied with your animated video, please contact us within 30 days of delivery at support@shutterlove.ai. We will work with you to address your concerns or provide a full refund.

8. Intellectual Property

The Service, including its original content, features, and functionality (excluding User Content), is owned by ShutterLove and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

9. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use automated systems to access the Service
• Reverse engineer or decompile any part of the Service
• Resell or commercially exploit the Service without authorization

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHUTTERLOVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless ShutterLove and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
